These Terms of Use govern the conditions and procedures for using the website and services (the "Service") operated by AMITABHA (the "Brand"). By accessing this site or purchasing products, you unconditionally agree to all terms and conditions set forth herein.
Art. 1 (Governing Law & Jurisdiction)
These Terms and all disputes arising from the use of the Service or purchase of products shall be governed by and construed in accordance with the laws of the Republic of Korea. (Art. 25, Act on Private International Law)
Any legal action arising between the Brand and the user shall be subject to the exclusive jurisdiction of the competent court in the Republic of Korea (e.g., Seoul Central District Court). (Art. 29, Civil Procedure Act)
Art. 2 (Artistic Definition & Liability)
All AMITABHA products are .925 Sterling Silver 'Artistic Objects' and 'Relics'.
These products are designed for decoration, collection, and artistic value. The Brand disclaims all liability for physical or property damage resulting from modification or misuse of the product as a "weapon." (Mutatis mutandis Art. 3, Product Liability Act – Immunity due to user misuse)
Under Art. 2 of the Control of Firearms, Swords, Explosives, etc. Act of Korea, these products are classified as artistic jewelry and crafts, not lethal weapons.
Art. 3 (Eligibility & Age Restriction)
Products are sold only to individuals aged 19 or older who understand their artistic value. (Art. 2 & 28, Youth Protection Act)
All legal and safety liabilities arising from purchases made by minors through deception regarding their age or without parental consent shall rest solely with the user or their legal guardian. (Art. 5 & 17, Civil Act)
Art. 4 (Protection of Intellectual Property)
All designs, images, trademarks, and unique forms (e.g., Relic series) on this site are the exclusive property of the Brand. (Art. 4, Copyright Act; Art. 33, Design Protection Act; Art. 82, Trademark Act)
Unauthorized reproduction, commercial resale, or manufacturing of similar products shall be subject to strict civil and criminal actions under Art. 2, Sec. 1 (k) of the Unfair Competition Prevention and Trade Secret Protection Act.
Art. 5 (Handcrafted Nature & Cancellation)
Minor variations in texture and oxidizing are "Artistic Intentions" and do not constitute defects.
Under Art. 17, Sec. 2, No. 6 of the Electronic Commerce Act, cancellation of orders (refunds) is restricted for custom-made products or jewelry whose value significantly decreases upon being worn.
Art. 6 (Shipping & Customs Risk)
Users bear all risks of seizure, destruction, or return by customs based on local "Weapon Classification" standards. (Art. 234, Customs Act & External Trade Act applied)
Users are responsible for verifying local import regulations. The Brand is exempt from refund obligations for losses caused by customs rejection. (Art. 390, Civil Act – Immunity for non-performance of obligation)
Art. 7 (Modification & Service Limitation)
Products physically modified or repaired by unauthorized third parties lose their status as authentic products.
The Brand reserves the right to refuse after-sales service (A/S) for modified products. (Art. 7, Act on the Regulation of Terms and Conditions)
